TERMS OF SERVICE

These Terms of Service govern your access to and use of the website located at overlandram.ca, including its pages, forms, features, inventory listings, financing tools, communications, and related services.

The website is operated by Overland RV Auto Motorsports, referred to in these Terms as “Overland,” “we,” “us,” or “our.”

By accessing the website, submitting a form, creating an account, requesting information, or using any of our website services, you agree to these Terms. If you do not agree, please do not use the website.

01 — ABOUT OUR SERVICES

Overland provides information about vehicles, inventory, purchasing options, financing assistance, and related products and services. Vehicles may include cars, trucks, SUVs, recreational vehicles, trailers, motorcycles, ATVs, side-by-sides, snowmobiles, boats, personal watercraft, and other vehicles or equipment.

Some vehicles displayed or discussed through the website may be:

  • Owned or offered by Overland;
  • Supplied through another dealership, seller, or partner;
  • Located off-site;
  • Subject to financing approval; or
  • Unavailable by the time you make an inquiry.

Information submitted through the website may be used to help identify potential vehicles, financing options, lenders, dealers, sellers, warranty providers, insurers, or other service providers.

02 — OVERLAND IS NOT NECESSARILY THE LENDER

Unless expressly stated otherwise, Overland is not the financial institution providing the loan or credit product.

We may assist you in preparing or submitting an application to one or more independent banks, credit unions, finance companies, lenders, brokers, dealers, or other financing sources.

Each lender independently determines:

  • Whether to approve an application;
  • The amount of credit offered;
  • Interest rates;
  • Loan duration;
  • Payment amounts;
  • Down-payment requirements;
  • Security requirements;
  • Required supporting documents; and
  • Any other financing conditions.

Submitting an application or receiving a preliminary response does not guarantee approval, funding, vehicle availability, or any particular financing terms.

03 — ELIGIBILITY AND ACCURATE INFORMATION

You must be legally capable of entering into a binding agreement in your province or territory to submit a financing application or complete a transaction.

You agree to provide information that is accurate, complete, current, and not misleading. You must not submit information using another person’s identity or without the necessary authority or consent.

If you submit information for a co-applicant, guarantor, business, spouse, or another individual, you represent that you have authorization to provide that information and that the individual understands how the information may be handled.

We may decline, suspend, or stop processing an inquiry or application if we believe information is incomplete, inaccurate, fraudulent, unauthorized, or unlawful.

04 — FINANCING AND CREDIT APPLICATIONS

A financing request may require information such as:

  • Full legal name;
  • Date of birth;
  • Contact information;
  • Residential history;
  • Employment and income information;
  • Banking or financial information;
  • Government-issued identification;
  • Vehicle or trade-in information; and
  • Other information reasonably required to process the application.

Additional consent may be requested before a credit report is obtained or before information is submitted to a lender. Any credit authorization, financing application agreement, purchase agreement, or lender agreement presented to you forms a separate agreement and may contain additional terms.

If there is a conflict between these Terms and the specific terms of a signed financing, credit, purchase, lease, warranty, insurance, or vehicle agreement, the specific agreement will govern the applicable transaction.

05 — NO GUARANTEE OF APPROVAL

Statements such as “all credit considered,” “bad credit financing,” “zero down,” “cash back,” “fast approval,” “same-day approval,” or similar promotional language describe programs or options that may be available to qualified applicants.

They are not guarantees.

Approval and financing terms depend on factors that may include credit history, income, employment, debt obligations, vehicle selection, lender requirements, residency, identification, down payment, trade-in value, and the accuracy of the information supplied.

06 — INVENTORY, PRICING, AND VEHICLE INFORMATION

We make reasonable efforts to provide accurate vehicle information. However, inventory, photographs, specifications, mileage, condition, features, pricing, payment examples, incentives, and availability may change without notice.

Vehicle images may be illustrative, digitally enhanced, supplied by manufacturers or third parties, or show options that are not included with a particular vehicle.

Unless expressly stated otherwise:

  • Prices may exclude taxes, registration, licensing, financing charges, lender fees, delivery, accessories, warranties, insurance, documentation charges, and other applicable fees;
  • Payment examples are estimates only;
  • Inventory is subject to prior sale or withdrawal;
  • Vehicle availability is not guaranteed; and
  • Errors may be corrected at any time.

Final pricing, vehicle condition, included equipment, financing terms, and transaction details will be set out in the applicable written agreement.

07 — TRADE-INS AND VEHICLE VALUATIONS

Any online, telephone, or preliminary trade-in value is an estimate and is not a binding offer.

A final trade-in value may depend on physical inspection, mechanical condition, mileage, accident history, liens, ownership records, market conditions, reconditioning requirements, and verification of the information provided.

You are responsible for disclosing any liens, damage, modifications, insurance claims, ownership issues, or other material facts relating to a proposed trade-in.

08 — ELECTRONIC COMMUNICATIONS AND SIGNATURES

By submitting your contact information, you authorize us to respond to your request using the methods you selected or provided, including telephone, email, and text message.

Marketing communications will be managed in accordance with applicable consent requirements. You may unsubscribe from marketing emails using the unsubscribe link provided or from marketing text messages by following the instructions in the message.

Unsubscribing from marketing does not prevent us from sending non-promotional communications relating to an active application, requested service, transaction, account, safety matter, or legal obligation.

Where permitted, electronic records and electronic signatures may be used in connection with applications and transactions. You are responsible for reviewing documents before signing them and retaining copies for your records.

09 — WEBSITE ACCOUNTS

Some website features may allow you to create an account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials;
  • Using a strong and unique password;
  • Restricting access to your device or account;
  • Providing accurate account information; and
  • Notifying us promptly if you suspect unauthorized access.

You are responsible for activity conducted through your account unless prohibited by applicable law.

We may suspend or terminate an account that appears to be compromised, fraudulent, inactive, misused, or operated contrary to these Terms.

10 — ACCEPTABLE USE

You may view and use the website for your personal, non-commercial use. No other rights are granted.

You may not reproduce, distribute, modify, publish, sell, license, publicly display, or commercially exploit website content without prior written permission from the applicable rights holder.

Third-party trademarks, manufacturer names, vehicle names, and logos remain the property of their respective owners.

12 — THIRD-PARTY WEBSITES AND SERVICES

The website may link to or integrate with services operated by lenders, dealers, manufacturers, credit bureaus, mapping providers, social networks, payment providers, analytics providers, customer relationship management platforms, or other third parties.

Third-party services are governed by their own agreements and privacy practices. We do not control and are not responsible for the availability, security, accuracy, content, or practices of an independent third-party service.

A link or integration does not necessarily mean that we endorse every product, statement, or practice of the third party.

13 — WEBSITE AVAILABILITY

We do not guarantee that the website will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, restrict, or discontinue any portion of the website without notice. We may also perform maintenance, correct errors, remove content, or change website features at any time.

14 — DISCLAIMER

To the fullest extent permitted by law, Overland disclaims warranties and representations regarding:

  • Financing approval;

Nothing on the website constitutes financial, legal, tax, accounting, insurance, or investment advice. You should obtain independent professional advice when appropriate.

Nothing in these Terms excludes a warranty, right, or remedy that cannot legally be excluded under applicable consumer-protection law.

15 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Overland and its directors, officers, employees, representatives, contractors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses arising from your use of or inability to use the website.

This includes loss of data, revenue, opportunity, anticipated savings, goodwill, or business interruption.

Where liability cannot be excluded, our liability will be limited to the extent permitted by applicable law.

This section does not limit liability for fraud, wilful misconduct, gross negligence, or any other liability that cannot legally be limited.

16 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Overland and its directors, officers, employees, representatives, and contractors from claims, losses, liabilities, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the website;
  • Information you submit without authorization;
  • Your violation of these Terms;
  • Your infringement of another person’s rights; or
  • Fraudulent, deceptive, or malicious activity conducted through your account.

This obligation does not apply to the extent a claim was caused by Overland’s own unlawful conduct, negligence, or breach of its obligations.

17 — SUSPENSION AND TERMINATION

We may restrict or terminate your access to the website if you violate these Terms, misuse the website, create security or legal risk, or engage in suspected fraudulent or unlawful conduct.

Sections that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, disclaimers, liability, indemnification, and governing law.

18 — GOVERNING LAW

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles.

Subject to any mandatory consumer-protection rights or jurisdictional requirements, disputes relating to these Terms or the website will be submitted to the courts of Alberta.

19 — CHANGES TO THESE TERMS

We may update these Terms to reflect changes in our website, services, business practices, or legal obligations.

The updated version will be posted on this page with a revised effective date. Your continued use of the website after an update means that you accept the revised Terms.

Material changes will be communicated where required by law.

20 — GENERAL PROVISIONS

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of that provision.

These Terms, together with the Privacy Policy and any transaction-specific agreement, constitute the applicable agreement regarding your use of the website.
